Debt collection agency, BPO or law firm: which one to hire for your receivables in Colombia
When a company decides to take the collection of its overdue invoices out of the office, it usually searches for “debt collection agency” and hires the first one that answers. It rarely asks what kind of organisation it is hiring, and even less whether that kind suits the receivables it has.
The problem is not outsourcing collection. The problem is that in Colombia three very different models live under the same word, and most companies only know one: the call center. Few know that there are law firms dedicated exclusively to reviewing and collecting business receivables. At Trébol Jurídico we explain how they differ, which receivables each one is for, and how to keep a wrong choice from costing you both the invoice and the customer.
What are the three collection models in Colombia?
| Model | Which receivables it is for | How it collects | If the debtor does not pay |
|---|---|---|---|
| Call center or collection BPO | Thousands of low-value obligations: consumer credit, utilities, telecommunications. | Mass contact by script: automated calls, messages and emails. | The process ends; the case is returned or passed to another firm. |
| Pre-legal collection agency | Mixed receivables of medium value. | Telephone and written negotiation, payment agreements. | Without its own lawyers it cannot file suit; the case file changes hands. |
| Debt collection law firm | Higher-value invoices, promissory notes and contracts between companies (B2B). | Legal review of the instrument, conciliatory negotiation and secured agreements. | Enforcement proceedings, attachment orders and representation in insolvency. |
None is better than the others in the abstract. A mass BPO is the right tool for a hundred thousand low-value consumer loans. It is the wrong tool for thirty industrial supply invoices of forty million pesos each.
What is the difference between a collection agency and a debt collection law firm?
A collection agency or BPO manages volume: thousands of small obligations through mass contact. A debt collection law firm manages cases: specific, higher-value obligations, with legal review of the instrument and the ability to file suit. It is not a difference of size or price. It is a difference of method.
In money terms, that decides three things. Who reads your contract and your invoice before calling the debtor. What happens when the debtor says no, because that is where a BPO stops and a lawyer starts. And whether your claim is protected when the debtor becomes insolvent, something only a lawyer can do.
What happens when receivables end up in the wrong model?
- They collect by script, without reading the paperwork. Nobody checks whether the invoice was accepted, whether the promissory note (pagaré) has its letter of instructions, or whether the obligation is already under commercial dispute.
- Mass collection breaks the relationship. Ten automated calls to the finance manager of your best customer recover one invoice and lose the account.
- The debtor’s “no” is the end of the road. When persuasion runs out, whoever has no lawyers cannot file suit; the case file changes hands and starts from scratch.
- The instrument expires while they keep insisting. The action on the invoice and on the promissory note expires in three years, and a phone call does not stop that clock.
- Your claim is left out of the agreement. If the debtor enters reorganisation and nobody makes sure your claim is properly recognised, you find out when the agreement has already been signed without your invoice.
What tools does the law provide, and who can use them?
The difference between the models becomes tangible when you look at the tools the law provides and who can use them.
An accepted electronic invoice is a negotiable instrument (título valor) under Law 1231 of 2008 and Decree 1154 of 2020, just like the promissory note. That opens the door to enforcement proceedings (Article 422 of the Colombian General Code of Procedure), which allow the debtor’s assets and bank accounts to be attached. To file that claim on behalf of your company you need a lawyer with power of attorney: a BPO cannot do it on its own. And time is limited: the direct action expires three years from the due date (Article 789 of the Commercial Code).
When the debtor is a company in crisis, the scenario changes. Under Law 1116 of 2006, as amended by Law 2437 of 2024, admission to reorganisation suspends individual enforcement actions, and each creditor has to make sure its claim is properly recognised and ranked, and object in time if it is not. The context does not help: according to the Superintendency of Companies (Superintendencia de Sociedades), 391 companies entered liquidation in 2025 and more than 1,250 in the last four years. Among natural persons, insolvency filings reached 18,726 in 2025, 76% more than in 2024, and the Guarantee Fund (FGA) projects close to 26,640 in 2026. That queue is handled by a lawyer or by nobody.
And for consumer receivables, Law 2300 of 2023 sets the days, hours, frequency and channels of contact with debtors who are natural persons. It is the rule that weighs most on the mass models, because it limits precisely the volume of contacts they rely on.
How does Trébol Jurídico’s legal collection service work?
We are a law firm dedicated exclusively to recovering business receivables. We do not manage volume by script: every obligation we receive has a lawyer in charge and a plan. See our legal collection service.
- Legal review of the instrument before the first action: accepted invoice, promissory note, contract, guarantees and the debtor’s real situation.
- Conciliatory pre-legal collection, with notice to the debtor within 24 hours, so that you collect without breaking the commercial relationship with your customer.
- Asset search before filing suit. If the debtor has nothing to answer with, we tell you before you spend on proceedings.
- Enforcement proceedings and attachment orders when the debtor does not respond and you authorise it, within the same firm and with the same case file as the pre-legal stage. While the proceedings move forward, we keep negotiating outside the courtroom.
- Representation in insolvency proceedings: recognition of your claim and follow-up through to the payment agreement.
- Payments go directly to your account, with no advance or monthly fee, and fees on what is actually recovered; also in our debt collection service for the pre-legal stage.
- Real-time tracking in Trébol@net, our software.
An example: a very old obligation of 350 million pesos. The client asked to go straight to court. We filed the claim and, in parallel, kept negotiating. With the attachment order already granted by the court, the debtor paid the principal plus 320 million in interest: 670 million pesos recovered.
Frequently asked questions
Only through lawyers. Enforcement proceedings are filed before a judge and, to sue on behalf of your company, a lawyer with power of attorney is required. If the agency has no lawyers of its own, the case goes to another firm and the file starts from scratch. A debt collection law firm, such as Trébol Jurídico, negotiates and sues with the same case file.
